We Won This Round — Help Us Finish the Fight
I am pleased to share an important development in a case that goes to the heart of whether vulnerable patients will be protected — or coerced toward death. Our legal team just secured a significant victory at the Ontario Court of Appeal in the case of Roger Foley.
Roger lives with a debilitating neurodegenerative condition and relies on continuous assistance for basic needs. His medical team has been repeatedly pressuring him to end his life by assisted suicide rather than providing the care he needs. His case raises deeply troubling questions about what can happen when a medical system treats death as a solution to suffering.
Until now, Roger’s claims had effectively been shut down due to a previous court ruling that led to the dismissal of his case. But this week, the Court of Appeal granted an extension of time to challenge that decision—an essential step that opens the possibility of reinstating his case. This will allow our team to pursue damages for the abusive treatment Roger has endured and will ensure that he receives proper care going forward.
This is not the end of the fight, but it is a critical breakthrough. Without this ruling, Roger’s case would have come to an end—but now we have a path forward.
Roger’s legal team must now prepare and file the next stage of the appeal by March 31, 2026—a tight deadline that requires significant legal work in a very short period of time. As is often the case in complex litigation, the opposing parties have already forced extensive additional briefing, increasing the time and effort required to properly present Roger’s case.
I want to share candidly that the attorneys involved have already gone above and beyond to make this possible. They have contributed substantial time outside their normal commitments, and even absorbed thousands of dollars in costs rather than allow financial constraints to hinder this effort. Their commitment reflects just how important this case truly is.
At the same time, continuing this work will require additional resources. We are now working to ensure that Roger’s appeal can move forward without interruption, so that his claims can be heard on the merits and the serious issues he has raised are not left unresolved.
Roger has shown remarkable courage in standing firm under circumstances that would have overwhelmed many. This recent ruling gives us a renewed opportunity to stand with him—and to ensure that the principle at stake here is not lost.
