The Reality is Shocking:
- Over 75% of hospice providers today are for-profit companies, run by investors seeking to profit from the vulnerabilities of those experiencing terminal illness.
- Medicare paid $23.7 billion for hospice care in 2022 alone, and too often that money went to providers engaging in fraud.
- CMS—the agency responsible for oversight—admits that millions are being stolen each year, yet enforcement is weak, and fraudulent hospices continue to operate unchecked.
This is not just a financial issue—it’s a life and death issue. Bad actors are exploiting the system, making false claims and billing for services they do not provide. Even worse, we have seen patients who don’t even qualify for hospice placed on end-of-life care plans and deprived of medical treatments they need to survive.
That’s why Life Legal has joined other advocates in signing a formal letter to Elon Musk and the Department of Government Efficiency (DOGE), urging them to take immediate action to stop hospice fraud. We are calling for the formation of a task force to investigate corruption within Medicare’s hospice division and hold fraudulent providers accountable.
We see firsthand what happens in some of these for-profit hospice facilities when family members call us to ask for help when their loved one’s food, water, and life-saving medication have been withdrawn without consent.
We have had to sue hospitals and hospice facilities to restore basic care, such as nutrition and hydration, to patients—some of whom go on to make a full recovery.
